PROTECTION FROM ABUSE (PFA)
The Domestic Relations Statute provides for the ability to petition the Court for an order for protection from abuse.
The statute provides that you may file a petition against a family or household member if there are instances of abuse.
If the Court finds that there is abuse, then they may enter an order directing any of the following:
-
That the Defendant refrain from abusing the Plaintiff or the minor children;
-
Granting possession of the residence to the Plaintiff and excluding the Defendant from the residence;
-
Awarding temporary custody;
-
Prohibiting contact by the Defendant with the Plaintiff;
-
Prohibiting the Defendant from acquiring or possessing a firearm;
-
Directing the Defendant to pay Plaintiff for reasonable losses suffered as a result of the abuse;
-
Directing the defendant to refrain from stalking and harassing Plaintiff;
-
Any other appropriate relief.
What constitutes abuse under the statute and protecting your rights during a hearing for a Protection from Abuse hearing are important. If you have questions regarding a PFA call our office at 724-836-3300.
